Terms and Conditions of Dah Sing Autotoll Visa Card Promotion

-Promotion period starts from now till December 31, 2008 ("Promotion Period").
-This offer is exclusively for new Dah Sing Autotoll VISA Principal Cardholder. Each Principal Cardholder can enjoy the offer only once.

 
  1. WELCOME GIFT
    1. Caltex HK$200 Cash Coupon: Applicant who has successfully applied for Principal Autotoll VISA will be entitled to a Caltex HK$200 Cash Coupon by accumulating a retail purchase or cash advance of HK$2,000 or above within 2-month of card issuance. The redemption letter regarding the welcome gift will be sent to the eligible Principal Cardholder within 6-8 weeks upon fulfilling the spending requirement and the relevant Credit Card Account must be valid and in good standing status at the time of issuing the redemption letter, otherwise Cardholder will not be entitled to the welcome gift. *
    2. Up to HK$60,000 and 15 months Interest Free Cash in Plan Instalment Offer: This offer is only applicable to the brand-new Principal Dah Sing Bank Credit Card Cardholder; Cardholder who has terminated any Dah Sing Credit Card (whatever the Principal Card or Supplementary Card) before 12 months from the date of this Promotion Period or who currently owns any Dah Sing Credit Card, he/she will not be entitled to this offer and will be arranged to have Caltex HK$200 Cash Coupon as a welcome gift (Please refer to the above item (a) for the terms and conditions). The minimum amount for "Interest Free Cash-in Installment" is HK$3,000 while the maximum is HK$60,000 (depends on the approved credit limit of Dah Sing Credit Card account). Dah Sing Bank ("the Bank") has the absolute discretionary right to determine "Interest Free Cash in Plan Instalment" amount. "Interest Free Cash in Plan Instalment" amount reply slip will be mailed to the Principal Cardholder within one month whilst designated Card has been approved, applicant is required to return the reply slip and required document within 60 days upon card issuance. While the Bank received the reply slip, the Bank will credit the approved "Interest Free Cash in Plan Instalment" amount to the applicant's designated personal Hong Kong dollar currency bank account ("the Relevant Account") within 7 working days. Amount receivable bank may deduct the handling fee from the Relevant Account. If the Plan is early settled or cancelled by Customer for whatever reason, the Bank reserves the rights to charge the Customer HK$300 Installment Plan Cancellation fee. The Bank is not liable for the mentioned handling fee or any interest or other expense caused by this. The applicant has to arrange the amount with receivable bank for the expense or interest directly (if applicable). The Bank will debit the Credit Card Account with the approved "Interest Free Cash in Plan Instalment" amount by 15 consecutive monthly instalments, commencing from such date as the Bank may prescribe at its discretion. The Bank will debit an amount equivalent to the "Interest Free Cash in Plan Instalment" amount from the credit limit of the Credit Card Account until the last instalment has been debited. The Bank will proportionally increase the deducted credit limit every month after the Bank successfully debits the Credit Card Account with the instalment amount due. On default of payment of any moneys due under the Credit Card Account or in case of breach of any provisions of the applicable terms and conditions governing the use of Dah Sing Credit Card Cardholder Agreement ("Agreement") or any of these terms and conditions by applicant or in case of cancellation or termination of the Credit Card Account or "Interest Free Cash-in Plan Instalment" for whatever reason, all outstanding instalments or balance or moneys owing under these terms and conditions shall immediately due and payable by applicant and shall at the absolute discretion of the Bank, be debited against the Credit Card Account. Therefore, the Agreement shall apply to all the said installments or balance. The Bank has the right to accept or reject any application without providing any reasons; "Interest Free Cash-in Plan Instalment" is not applicable for "Cash Reward Scheme". Notwithstanding the other provisions in these terms and conditions, the Bank shall be entitled at any time with notice to the applicant to suspend or terminate "Interest Free Cash-in Plan Instalment". These terms and conditions shall form part of the Agreement and shall be construed accordingly. In case of any conflict between these terms and conditions and the Agreement, these terms and conditions shall prevail. *
    3. HK$200 Caltex with Techron® Gasoline Discount Coupon( HK$20 x 10pieces): Applicant who has successfully applied for Principal Autotoll VISA will be entitled to a Caltex HK$200 Gasoline Discount Coupon s. With no spending requirement The coupons will be sent out with your new Card.
    4. Permanent Autotoll Administration Fee Waiver: simply make a monthly spending of HK$3,500 or above with your Autotoll VISA to entitle waiver of your Autotoll Administration Fee of the month.
  2. 1.2 Autotoll administration fee will be debit from cardholders and it will be automatically rebated to your Autotoll VISA Account every month (Name of applicant and name of Autotoll account holder should be identical)

    1.3. The retail purchase or cash advance of Supplementary Cardholder will be counted towards the Principal Cardholder's record. The welcome gift is applicable to new Principal Cardholder only. In case the applicant applies for more than one Principal Card, only ONE welcome gift will be offered. Spending includes retail transactions, cash advance, "Cash-in" Plan amount, Balance Transfer amount, Credit Card Cheque transactions, bill payment amount, Interest-free Installment transactions and Octopus Automatic Add-Value amount, excluding bank handling fees (including annual fees, financial charges, late fees and cash advance handling fees), casino transactions, unposted/ cancelled/refunded and unauthorized transactions.

    1.4 The quantity of the welcome gift is on a first-come-first-served basis while stocks last. In the event that a gift item is out of stock, the Bank reserves the right to substitute the welcome gift with another offer. All welcome gifts shall be redeemed with the original redemption letter within the designated redemption period, it will be invalid upon expired. The welcome gift cannot be redeemed for cash or transferred. The Bank does not warrant the quality and quantity of the products provided by the merchants. The Bank and the participating merchants reserve the final right to amend these terms and conditions or terminate the promotion at any time without prior notice.

    1.5 If cardholder terminated the Autotoll service, Autotoll Automatic Top-Up Service or Autotoll VISA within 12 months of card issurance, the monthly Autotoll Administration Fee Waiver will be cancelled automatically. The Bank reserves the right to charge a handling fee of HK$420 for the welcome offer without prior notice.

    1.6 Regarding the HK$200 Caltex Discount Coupons (HK$20 x 10pieces) and HK$200 Caltex Cash Coupon, the details of redemption are subject to the terms and conditions as printed on the coupons. The coupons will be sent out with your new Card.

    1.7 All matters and disputes will be subjected to the final decision of the Bank and participating merchants. The above gift pictures are for reference only.

    1.8 In case of any discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.

  3. "Prepaid Amount" varies with the class of your vehicle. The "Autotoll Automatic Top-Up Service" will be effective within 2 weeks after your card is approved.
  4. Regarding the Caltex discount, it will be automatically rebated to your Autotoll VISA Account every month. Offer is applicable to Autotoll VISA transactions approved at pumps only.
  5. Applicable to retail spending only, excluding Autotoll transactions, cash advances, casino transactions, Cash-in Plan amount, Balance Transfer amount, bill payment amount, Happy Tax amount, financial charges, handling fees, interest-free installment transactions and unposted/cancelled transactions/transactions eventually returned and all unauthorized transactions. For the details, please refer to our latest promotional leaflets.
  6. To enjoy the offers, cardholder must present Autotoll VISA upon purchase and settle the payment with the Card. All offers are valid until December 31, 2008(unless specify). For details, please refer to the year round leaflet which will be sent out with the new welcome pack. Offers cannot be exchanged for cash. Dah Sing Bank shall not be responsible for any matters relating to the products or services provided.“AutoPark 1% Parking Fee Rebate: Offer is only applicable to Cardholder who use Autotoll VISA for “Autotoll Automatic Top-Up Service”. Rebate will be given to Cardholder in the following month after the spending month. Cardholder’s Autotoll VISA account and “Autotoll Automatic Top-Up Service” must be valid by date of rebate. Only parking fees spend with Autotoll Park Service at designated Wilson Parking car parks can be entitled to 1% rebate.
  7. Exclusive personal banking and financial service privileges are valid until December 31, 2008. Dah Sing Bank reserves the right to make the final decision on the approval of personal banking and financial service applications without giving reasons. Gifts are available on a first-come-first-serve basis while the stock lasts. Dah Sing Bank shall not be responsible for any matters relating to the products or services provided.
  8. The annual rate of retail purchase is 19.8% (APR 20.91%) and 24.8% (APR 29.36%) for cash advance.
  9. "Cash-in Plan": This plan is only applicable to Principal Cardholder (excluding Supplementary Cardholder). No Bonus Point will be awarded for this Plan. A monthly handling fee will be charged. Please refer to the promotional leaflet for the updated promotion. "Cash-in Plan" is only applicable to local personal bank account holder and is not applicable to joint accounts.
  10. "Jetso Installment” Plan is only applicable to transaction(s) (combined transactions apply) valued at HK$800 (or same value foreign currency transaction) or above. All combined transactions must be made under the same Credit Card account. Cardholder needs to apply at least 10 working days before payment due date of the transactions, as printed on the monthly statement (application apply to transaction(s) made within recent 2 months) and keep the related sales slip(s) for proof. Dah Sing Bank has the right to accept or reject an installment plan application without the need to provide reasons. In case of any dispute, the decisions of Dah Sing Bank shall be final. This installment plan shall be subject to the terms and conditions of "Happy Installment" and the related terms and conditions can be downloaded from www.dahsing.com, or call 2828 8168 for details.
  11. Comprehensive E-banking Services: For payment with Autotoll VISA, a service fee of 1% of the payment amount will be charged (applicable to pre-registration merchants only). For information of the merchant list, please visit www.dahsing.com. No Bonus Point will be awarded for the e-banking services.

AUTOTOLL LIMITED Personal Information Collection Statement

This Statement is made by Autotoll Limited ('Autotoll') in accordance with the Personal Data (Privacy) Ordinance Cap.486 Laws of the Hong Kong Special Administrative Region ('the Ordinance') which is intended to notify you the purpose(s) for which data about yourself is being collected, the possible usage(s) and transfer(s) thereof, and the details as to data access, correction and security. It shall be binding on any person who has applied for any services of Autotoll whose application has been accepted or any person who has purchased the Autotoll Tag and activate it in accordance with the prescribed procedure.

  1. Collection and Use of Data
    1.1 For provision of services
    • It is necessary for us to collect and use recurrently subsequently and / or continuously and kept up-to-date on an ongoing basis data about yourself as our customers (whether living individuals or corporations) for the purposes of carrying out and administering the services which we are engaged to provide to you from time to time which currently include:-
      ( i ) electronic toll collection, AutoPark and related services;
      ( ii ) intelligent transport related systems and services;
      ( iii ) global positioning system (GPS) and services;
      ( iv ) the operation of e-shopping, the Club and related activities; and
      ( v ) general marketing of products and services in relation to 1.1(a)(i) to (iv) above.
    • Data about yourself to be collected from you includes the data you provide to us from time to time for our provision of services to you as well as other data Autotoll may collect or generate in its course of providing the services to you.
    • Generally, data about yourself collected from you and/or generated by us in relation to you will be used for the opening, maintaining and operating of customer account(s) with you and for the provision and invoicing of our services, handling of customer enquiries, complaints, suggestions and suspicious transactions, conducting customer surveys, tailoring, designing and marketing services and products for customers.
    1.2 Intelligent transport related systems and services
    • Autotoll also operates certain intelligent transport related systems and services (“Intelligent Transport System ” ) which currently includes the Real Time Traffic Information System (RTIS).
    • As part of the Intelligent Transport System by Autotoll, it may at Autotoll 's toll booths and other locations capture the data as included in your Autotoll tag and/or GPS on-board unit as well as the time your vehicle carrying such tag and/or GPS on-board unit passes through such location(s). Such data will be processed and used as data for our Intelligent Transport System and our research or survey in relation to the Intelligent Transport System. However, before the relevant data is processed by the Intelligent Transport System, the part of the data which can identify you will be masked and there is no way in which any data can be traced back to you or be used to identify you.
  2. Disclosure and Transfer of Data Collected
    2.1 Data about yourself collected and held by Autotoll will be kept confidential and will not be disclosed by Autotoll to any other third party in a form that will identify you individually save that Autotoll may provide, disclose and transfer such data to:-
    • any other branch offices, subsidiaries or associated companies of Autotoll;
    • any actual or proposed assignee of Autotoll or transferee of Autotoll's rights in respect of the party which takes over the business of Autotoll or into which Autotoll is merged or engaged by way of business joint venture, partnership or contract;
    • any person when Autotoll is compelled to make disclosure under the requirements of any law binding on it or any of its branches, including, without limitation, tax and law enforcement authorities etc.;
    • any person with the express or implied consent of the data subject;
    • any agent, contractor, or third party service provider who provides administrative, telecommunications, computer or other services to Autotoll in connection with the operation of its business;
    • any other person under a duty of confidentiality to Autotoll including members of Autotoll and other associated or joint venture parties and related businesses which have undertaken to keep such information confidential;
    • any person where the public interest or national security requires such disclosure; and
    • in case of default or refusal of payment of any invoice, any debt collection agencies.
    2.2 All data collected in relation to the Intelligent Transport System will be masked before being used and transferred for such system. No information or data which can be traced back to you individually to whom the data is related will be passed or transferred to any third party.

  3. Rights of Access and Correction to Data Collected
    3.1 Pursuant to and in accordance with the terms of the Ordinance (including any applicable guidelines and regulations thereof from time to time),you may:-
    • check whether Autotoll holds data about yourself and may request access to such data;
    • request Autotoll to correct any data relating to yourself which is inaccurate;
    • ascertain Autotoll's policies and practices in relation to data and to be informed of the kind of personal data held by Autotoll; and
    • object to the use of data about yourself for any other additional business purposes than those as set out in 1.1 above as may be undertaken by Autotoll. Autotoll will not use data about yourself for these purposes if you choose to be opt-out and communicate your objection to that effect to Autotoll.

    3.2 In relation to any data access request under 3.1 above, Autotoll is entitled to charge a reasonable processing fee in accordance with the terms of the Ordinance.
    3.3 Nothing in this Statement shall limit your rights under the Ordinance.

  4. Data Security
    4.1 All data about yourself are stored on our server in Hong Kong and are accessible only to authorized employees and contractors of Autotoll. Autotoll has also employed state of the art technology to ensure that data about yourself cannot be assessed by unauthorized persons.
